THE VERDICT REVERSED
On Thursday, April 25, 2024, the New York State Court of
Appeals made a momentous decision: Weinstein’s rape conviction was
overturned. This unexpected turn of events paves the way for a fresh trial.
THE COURT’S FINDINGS
The Court of Appeals examined the original trial proceedings. They found that the trial judge had made biased rulings, including allowing women to testify about allegations that were not directly related to the case.
Such testimony, the court argued, served no material purpose and unfairly influenced the jury.
We conclude that the trial court erroneously admitted testimony of uncharged, alleged prior sexual acts against persons other than the complainants of the underlying crimes because that testimony served no material non-propensity purpose... The only evidence against defendent [Weinstein] was the complainants' testimony, and the result of the court's rulings ... was to bolster their credibility and diminish defendant's character before the jury."
The Way Forward
Judge Jenny Rivera labeled these errors as “egregious” and called for a new trial.
Weinstein’s accusers may once again be called to testify if prosecutors decide to pursue another legal battle.
